In this regard, Appellant urges the Administrative Appeal panel to reverse this denial and grant Appellant release on parole. It should be noted, where the possibility exists for Appellant to have received a fair parole hearing, it does not necessarily mean it was impartial and unbiased, rendering a decision that could be based on a political agenda outside the record. This is particularly disconcerting when there existed the potential for a fair hearing to result in an unfair determination.

In conclusion, the August 1, 2006, parole board decision regarding Anthony Bottom, 77A4283, should be reversed and he should be granted parole to enroll in the graduate program at Syracuse University as offered in the submitted parole plan.
