B) The August 1, 2006, parole board failed to give sufficient acknowledgment
of Appellants institutional record. In fact, it is difficult to believe
any member of the parole board adequately reviewed Appellant's institutional
record. The parole board did not know that Appellant had obtained Bachelor
of Science in Psychology and a Bachelor of Arts in Sociology from SUNY New
Paltz in 1994 until Appellant told them. They made no mention that Appellant
received two commendations for preventing two prison riots. No mention that
Appellant received certificates for raising funds for the Childrens Fund,
proposed to raise funds for the 9/11 victims, received certificates for
being the Office Manager of the Computer Literacy class, had established
sociology and poetry classes, been a Teacher's Aide, obtained vocational
certificates for Drafting, and established community self-help programs.
There was no acknowledgment of interpersonal relationship with staff or inmates.
However, Appellant informed that Parole Officer J. Jasniewski, who was in
the hearing room, had been a correctional officer at Auburn for 5 years prior
to becoming a Parole Officer. Parole Officer Jasniewski had the opportunity
to observe and interact with Appellant in those five years and note Appellant's
character and personality. But the parole commissioners never inquired and
learned Parole Officer Jasniewski' s impression of Appellant's social behavior
in the prison environment. This failure of the parole board further indicates
a negative predisposition to deny Appellant release on parole.
